General Terms and Conditions of the Confederation
The General Terms and Conditions (GTC) contain the contractual terms and conditions of the contracting authority. They serve to simplify business transactions. The Confederation's GTC are based on the Code of Obligations in essential questions.
Federal contracting authorities are obliged to apply the general terms and conditions in principle (Art. 11 para. 2 DGP, SR 172, 056.11). The negotiation of special and deviating contractual regulations is permissible if they are objectively justified. In this way, procurement contracts can be formulated in a needs-based and balanced manner for the respective procurement transaction.
The GTC of the Confederation have been adapted to the revised public federal procurement law. They apply from 1 January 2024.
